1.- Previous Considerations

The following clauses of purchase in our web page are exclusively adapted to the contractual relations between the users of the web page denominated CLIENTS and the seller Mania Online, S.L. Spanish society located in C/ Riera Garrap 40 of the population of Girona in the province of Girona with NIF ES B55130611 owner of the web site www.telescopiomania.com.

Users who make purchases in https://www.telescopiomania.com/ fully accept these terms and conditions being bound by them as they are drafted at the time of recruitment. It will be an indispensable requirement the reading and acceptance of the terms and conditions prior to the purchase of any product through www.telescopiomania.com

Mania Online, S.L. reserves the right to modify the terms and conditions at any time and without notice, these are always accessible from the website, so that the user can view or print them at any time.

2.- Object of the contract

The company Mania Online, S.L. undertakes to supply the products offered on our website in exchange for an economic benefit. The access and use of our website commits the customer to respect the Terms and Conditions and all the rules contained in this contract.

3.- Effective Date

These Terms and Conditions, together with the order confirmation, constitute the contract between Mania Online, S.L. and the Customer for the supply of products. No other Terms and Conditions shall apply.

It shall be understood that the CUSTOMER agrees to the general conditions provided for in this text from the moment he/she accepts that he/she has read and agrees to these Terms and Conditions.

4.- Placing the order

Any customer who is of legal age will be accepted and will be able to complete the order by filling in the personal data form that appears on the order formalization screen and which is accessed by clicking on the 'Confirm' button. Once the form has been filled in and the shipping and payment methods have been selected, the order can be finalized by clicking on the 'Finalize order' button.

Once you have placed your order we will send you a confirmation email detailing all the selected items you intend to purchase and assigning your order number, Mania Online, S.L. understands that you are making us an offer to purchase the items you have selected in accordance with these Terms and Conditions. At the time that Mania Online, S.L. accepts your order will be notified of acceptance by issuing an order confirmation, this confirmation will be made in the data provided by the CUSTOMER in the personal data form. In the case of non-acceptance the communication will be made by the same means.

Sometimes it may be that some of the items purchased can not be supplied for some reason, because the item is damaged or in poor condition for sale or not available in stock. Mania Online, S.L. undertakes to contact the CUSTOMER within 48 hours and inform you of the incident detected and make every effort to supply the item purchased or propose an alternative item, if you do not accept our suggestions we will cancel your order in relation to the items we can not supply and we will refund any amount of money that we had paid for such items. The refund of these sums of money will be the limit of our liability to the CUSTOMER.

The order will be shipped within the limits of available stock. If any of the ordered items are not in stock, we will inform you of the period in which we will be able to send you your product(s). If you are not interested in waiting, you may request a refund of the amounts you have paid for that item.

Mania Online, S.L. makes available to the customer on those items that can not be supplied together in your initial order to give away the shipping charges on any subsequent shipment to complete the total delivery of your order.

Very occasionally, the prices of products shown on our website may be erroneously specified and show a lower price than the corresponding price. When this happens and, if we have confirmed your order, we will contact you immediately in order to issue a new order confirmation with the correct price. In the event that the corresponding price is much higher, the CUSTOMER may cancel the order and we will refund any amount already paid.

The CUSTOMER has the right to revoke an order within 7 working days of placing the order and the time of revocation of the last day is 12.00 noon Spanish time. During the revocation period the Customer may cancel his order at no additional cost.

Mania Online, S.L. will supply all items indicated in the order confirmation, in accordance with these Terms and Conditions.

5.- Characteristics of the published articles

Mania Online, S.L. publishes on our website with the greatest possible attention and quality the information concerning the essential characteristics of the products through technical descriptions, photographs, videos, catalogs and operating manuals from its partner companies and manufacturers.

6.- Price list

The price of all items is clearly visible on the website. The price and conditions of the products offered may vary, but in any case the price and conditions that existed at the time of placing the order will always apply to the CUSTOMER.

All prices indicated on our website and for residents of the European Union are governed by the VAT rate in force in Spain according to the type of each item and its taxation. In the event that the CUSTOMER resides outside the European Union or in any special area of Spain as Canary Islands, Ceuta and Melilla prices do NOT include VAT, being at all times the responsibility of the customer to pay local taxes in the country or special area of destination.

The shipping price is calculated automatically depending on the destination, weight and volume of the goods to be shipped, the price can be in a range between 3,99€ and 60€ VAT included.

In some countries or areas there is also the charge of customs clearance, all these costs correspond to the CUSTOMER being charged by the transport company as an intermediary company. Tariffs and customs regulations vary in different countries and it is difficult to know exactly how they work and their costs.

Mania Online, S.L. will always inform the shipping cost of your order detailed before the order confirmation at the end of the contracting process.

7.- Accepted methods of payment

Payment on delivery (valid only in Spain)

Payment will be made in cash at the time of delivery of the order at the delivery address indicated in the order confirmation. This form of payment has an increase in the cost of the order of 2.5% of the order value with a minimum of 6 ¤ for the management of the reimbursement of the carrier. The maximum limit accepted in this mode is 500€.

Payment by credit card

The customer may choose to pay by credit card, the operation being carried out at the time of placing the order. Only Visa and Mastercard are accepted. Mania Online, S.L. uses the system called SSL (Secure Sockets Layer), payment system in a secure environment as it allows the encryption of the information transmitted during the transaction, ensuring the confidentiality of the same between the CLIENT and our bank.

If the CUSTOMER chooses to pay by credit card, the order will not be processed until the payment has been authorized by the bank. For security reasons, Mania Online, S.L. verifies payments made through this system.

8.- Delivery of your order

Mania Online, S.L. sends to the CUSTOMER all the products purchased at the delivery address provided by the CUSTOMER in the personal data form provided in the order confirmation.

The delivery process is defined in three well-defined points:

- Validation of the payment made by the CLIENT.
- Preparation of the order
- Reception of the goods by the transport company

This process takes place within a maximum of 24 to 48 hours from the validation of the payment.

Mania Online, S.L. will inform the CUSTOMER of the delivery of the goods to the transport company, via email so you can track the delivery of your order.

The delivery time of the order is established between 1 and 7 working days from the departure of our warehouses, depending on the type of transport chosen by the CUSTOMER. Hours and days are understood as working hours and days, excluding Saturdays, Sundays and local or national holidays at the location of Mania Online, S.L. or at the destination location. If for any reason attributable to Mania Online, S.L. this period is exceeded, we will inform the customer of the incident and will propose alternative solutions.

In some special areas Canary Islands or non-EU countries the delivery time may be extended to more days than usually established.

The CUSTOMER undertakes to ensure that he or another designated person is at the address indicated for the receipt of the goods. In case of not being there the first time, the carrier will insist several times. If the order still could not be delivered, it will be returned to us, with the consequent refund to the CUSTOMER of the payment made minus the cost of shipping and return of the goods that will be borne by the CUSTOMER.

If at the time of delivery is appreciated in a visible and clear way, without the need to manipulate the shipping packaging or the product itself, that a product has defects caused by damage caused by transport or is appreciated, in the same way, an error in the goods received, the CUSTOMER must record it on the delivery note and communicate it to Mania Online, S.L. by e-mail addressed to Mania Online, S.L. in the shortest possible time from receipt of the order and never more than 2 working days from receipt, to be able to urge the return of the product or products affected and proceed to the replacement by another in optimal conditions or make the refund of the price paid for it, as indicated in that fax or email.

9.- Warranties of supplied products

All products supplied by Mania Online, S.L. are guaranteed. We undertake to repair free of charge, replace with a new one or make the corresponding credit if any of its products suffer from a manufacturing defect within 3 years from the date of the purchase invoice, sometimes the manufacturer may offer a higher warranty, this being the one that will prevail. In all these cases all costs of returning the product and shipping the new product or the same repaired, borne by the customer. In any case Mania Online SL will authorize in writing how to proceed in the resolution of the incident directly from our store or through the technical service of the brand. Once the warranty period is over, the costs of repair, replacement of the product will be borne by the CUSTOMER as well as all related transport costs.

If the customer wants us to take care of the collection of the item this service will cost 12.95 € for mainland Spain and 15 € for the Balearic Islands. This service is NOT available for the Canary Islands, Ceuta and Melilla or for other countries different from Spain. In the case of an article weighing more than 8 Kg or its dimensions are large, this cost will be quoted in each case.

10.- Returns and exchanges

If the Customer is not satisfied with any of the products he/she has purchased, he/she may exchange or return the product to us, and obtain a refund of the price of the returned product within the established period.

Mania Online, S.L. offers a flexible return policy with no problems in receiving returned products for a refund or exchange, either because they do not fit or you have ordered the wrong items.

Products must be returned within 30 calendar days from the date of invoice and received in our warehouse.

- Products must be returned in their original box/packaging, if the packaging of the returned product is not the original or the product has deteriorated the return will NOT be accepted.

- The products must not have been used, except for the mere fact of checking the correct operation and / or use.

- The products must have been received in a protective packaging in addition to the box or packaging of the product itself to prevent damage to the product box, if not received in these conditions will NOT be accepted the return.

- The customer will bear the cost of transportation if the cause of the exchange or return is unrelated to Mania Online SL

The CUSTOMER must inform us of the lack of conformity of the product within 7 days of the issuance of the purchase invoice by email that you want to return a product. As soon as we are aware of the cancellation of the order we will proceed to refund the amount paid with the same payment method you used. In the event that an order is cancelled and Telescopiomania has made the transport free of charge to the customer, we will retain the amount of 14.95 € for transport sent by Telescopiomania in the initial order.

If the customer wants us to take care of the collection of the item, this service will cost 19,95 € for mainland Spain and 24,95 € for the Balearic Islands. This service is NOT available for the Canary Islands, Ceuta and Melilla. In the case of an article weighing more than 8 Kg or its dimensions are large, this cost will be quoted in each case.

In order to benefit from the new product to be exchanged, you must place a new order.

In case the product to be returned is an astronomical telescope, you must take into account the following aspects that may result in a depreciation of the value of the product. Check it well before shipping:

- Dovetail marked by use: Depreciation of 10%

- Rubber tripod blocks with wear marks: 5% depreciation

- Deteriorated or missing packing box: Depreciation of 25%

- Damage or scratches on the optical part: Return cannot be accepted

Return Policy for Solar Eclipse Eyewear and Sunscreens

In accordance with current regulations on personal protection products and articles for personal use, solar eclipse glasses are non-returnable and non-refundable once delivered to the customer.

Since this is an eye safety product designed for protection against solar radiation, its handling or use prior to a possible return makes it impossible to guarantee its original condition and level of protection. For this reason, and in accordance with the provisions of Article 103, letter e) of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users, the right of withdrawal is not applicable to these products.

By purchasing this item, the customer expressly accepts this condition and acknowledges that he/she may not exercise the right of withdrawal once the product is received.

12.- Obligations of MANIA ONLINE SL and the Customer

Mania Online, S.L. undertakes to make available to the Customer all the necessary information concerning the products it offers as well as orders. Mania Online, S.L. is not responsible for the non-execution of these conditions in case of force majeure and in case of fault of the CUSTOMER or an unforeseeable event by a person outside the contract.

The Customer undertakes to fill in the order forms and their fields according to the instructions indicated. The Customer also undertakes to pay the price of the product, with the corresponding taxes and shipping costs.

Only one promotional code is applicable per order, all current promotional codes can only be applied to items without any discount applied.

We remind you that it is advisable to keep a copy of the data contained in the purchased products. Mania Online, S.L. is not responsible for any loss of data, files or, in general, any damage resulting from a failure by the Customer to back up the data contained in the products purchased.

Mania Online, S.L.no is not responsible for any consequences that may result from improper use of the products sold.

13.- Protection of personal data

In accordance with the provisions of Law 15/1999 on Protection of Personal Data, we inform you that the data you voluntarily provide when making any purchase, as well as the IP address of the computer from which the purchase is made, will become part of a file owned by Mania Online, S.L. in order to manage your purchase, shipping, after-sales service and customer service. 14.- Intellectual Property

All content published on our website (illustrations, texts, names, brands, images, videos) are the property of Mania Online, S.L... Any partial or total reproduction of the content by any process and on any medium whatsoever is subject to prior express authorization from Mania Online, S.L.

15.- Applicable law and jurisdiction

This contract shall be interpreted and governed by the Spanish and European legislation in force.

CLIENT and Mania Online, S.L. submit, at its option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the domicile of Mania Online, SL.
